June 2019 Newsletter for Ohio's CTR Physicians

The CTR newsletter is distributed to physicians with an active CTR and provides important updates for the Ohio Medical Marijuana Control Program. 

The State Medical Board of Ohio approved 28 new certificate to recommend medical marijuana (CTR) applications in June bringing the total number of active certified physicians to 512. 

Qualifying Conditions Update

On Wednesday, June 12, the board voted to reject the petitions for depression, insomnia and opioid use disorder but decided to table votes on autism spectrum disorder and anxiety for additonal discussion and review.

A condition that has been rejected by the board will not be reconsidered unless new information, such as additional research or supporting evidence, is provided. 

The board is set to accept new petitions for additional conditions Nov. 1 through Dec. 31, 2019.

Updated Search Map Feature

Last month we emailed you a survey requesting CTR practice addresses to include on the physician search map. Using the information from the survey responses, we have updated the search map feature to show each submitted practice address. Click here to view the search map for the CTR practice locations.

We’ve also received feedback from some physicians who were granted a CTR but have no intention of making recommendations to patients. If you applied for a CTR for any purpose other than making patient recommendations (e.g. research, specialized CME, etc.) please let us know and we will not feature your contact information on the map.

If you received your CTR this month, or have not completed the survey, please provide a list of all addresses you wish to list on the medical marijuana physician locator by completing the survey below.

Ohio now has 18 operational dispensaries where a patient with a recommendation may purchase their medical marijuana product.

Advertising and Ownership

Although there are no CTR-specific advertising rules concerning medical marijuana, as a licensee of the Medical Board, you may not make false, fraudulent, deceptive, or misleading statements in the solicitation of or advertising for patients. See Ohio Revised Code, Section 4731.22(B)(5) for details.

As a certified physician, you also may not have ownership, or investment interest in or compensation agreement with any medical marijuana entity licensed or applicant seeking licensure. See Ohio Administrative Code, Rule 4731-32-02 (8) for details.

Patients Outside of Ohio

House Bill 523 legalized purchases of medical marijuana products from an Ohio-licensed dispensary, by Ohio residents in the Patient & Caregiver Registry. Currently, Ohio does has not have reciprocity agreements with other states and does not recognize out-of-state medical marijuana cards.

Standard of Care

All physicians with an active CTR are expected to follow the full list of requirements in Rule 4731-32-03 Standard of care in the Ohio Administrative Code.
