Ohio's CTR Physicians

This newsletter is distributed to physicians with an active Certificate to Recommend Medical Marijuana (CTR) and provides important updates for the Ohio Medical Marijuana Control Program (OMMCP). 

The State Medical Board of Ohio approved 8 new CTR applications since the December board meeting. As of January 13, 2021, the total number of active certified physicians is 679.

Medical Board Reviews Petitions 

The State Medical Board of Ohio received 30 petitions during the 2020 petition window. All petitions will be presented to the Medical Board's Medical Marijuana Committee during their February 10 meeting. At that time the committee will determine which petitions meet the requirements outlined in program regulation. These selected petitions will be open to a public comment period, then reviewed by experts and considered for possible addition to the OMMCP. A final board decision on additional conditions is expected this summer.

 

Physician Annual Report 

Ohio Revised Code 4731.30 and Ohio Administrative Code 4731-32-03 requires each physician with a CTR to submit an annual report to the Medical Board. To collect the annual report data, the Medical Board will be sending a survey to all certified physicians. Each physician will be asked to give their professional opinion on the effectiveness of medical marijuana for the conditions for which it has been recommended. The board will send additional information about the survey in the coming weeks. Please note, completion of the survey is a statutory requirement for all physicians with a certificate to recommend.

Ohio has 53 operational dispensaries where a patient with a recommendation may purchase their medical marijuana product.

State of Ohio Board of Pharmacy Updates

Patient Information

Physicians are encouraged to be diligent about accurately entering patient and caregiver information into the Registry. If a patient/caregiver’s information is not accurately entered, it will preclude the purchase of medical marijuana. Patients must contact their recommending physician to correct any errors in their Registry information.

 

OARRS Information

As a reminder, please ensure that your OARRS information is up-to-date with accurate contact information.  

 

Special Status Documentation

For patients seeking indigent or veteran status, documents of proof should be sent to the Board of Pharmacy after a patient’s information is entered into the Registry. To request indigent or veteran status, patients can send their documentation to MMCPRegistry@pharmacy.ohio.gov along with their name and date of birth.

 

Driver License, BMV-Issued Identification, and Patient/Caregiver Registration Extensions

The legislature has passed, and Governor Mike DeWine has signed, HB 404 which extends the deadline for all driver licenses and identification cards, as well as patient and caregiver registrations. If a patient or caregiver’s expiration date on their driver license or identification card, or on the patient or caregiver registration, is March 9, 2020 to April 1, 2021, the expiration date has been automatically extended and will remain valid through July 1, 2021. Therefore, dispensaries must accept all driver licenses, identification cards, and patient/caregiver registrations with expiration dates between March 9, 2020 and April 1, 2021.

 

NOTE: HB 404 does not apply to recommendations from physicians with a certificate to recommend medical marijuana. All patients must have a current recommendation to purchase medical marijuana personally or through a caregiver.

Available Products Update

To help inform physicians choosing to include instructions for use, the types of products currently available through the Medical Marijuana Control Program are listed below. 

 

Duty to Report

Ohio physicians and many other allied health care providers, regulated by the State Medical Board of Ohio, are obligated to report violations of law, rule and code of ethics standards to the Medical Board. Knowing a colleague is violating regulations and not reporting to the Medical Board not only puts patients at risk but also puts your license to practice in jeopardy. Failure to report can result in fines of up to $20,000 and disciplinary action.

 

While standards of care and scope of practice are specific to the type of health care you provide, you should be familiar with three main sets of regulations:

  1. Statutes: Laws are outlined in Ohio Revised Code (ORC). A link for each license type can be found on our website.
  2. Rules: Regulations that were created specifically by the State Medical Board of Ohio for its licensees. These are found in Ohio Administrative Code (OAC) and a link for each license type can be found on our  website.         
  3. Code of Ethics for your profession
In 2019, the State Medical Board of Ohio took additional steps to ensure licensees know the seriousness of their duty to report knowledge of misconduct. The board added a new section to the application and renewal process to ensure those applying for and renewing their licenses are aware of the duty to report. 
 

Licensees should not assume that by informing their supervisor their duty to report is fulfilled. Ohio law is clear when a licensee needs to report information directly to the Medical Board. Anyone, including licensees, can file a complaint directly with the Medical Board 24/7 through the confidential complaint hotline at 1-833-333-SMBO (7626) or online at med.ohio.gov.

Search Map Feature

If you applied for a CTR for any purpose other than making patient recommendations (e.g. research, specialized CME, etc.) please let us know and we will not feature your contact information on the map.

If you received your CTR this month or have not yet provided all of the addresses you wish to list on the medical marijuana physician locator, please complete the survey below. Your name and practice address will not appear on the search map until your survey is submitted. 

License Number

Please be aware, now that you have been granted a certificate to recommend, your official license number includes the suffix CTR. Example: 35.12345CTR. 

Standard of Care

All physicians with an active CTR must follow the full list of requirements in Rule 4731-32-03 Standard of Care in the Ohio Administrative Code.
